Better than that, if you have buddies in FedEx, go bug them to accompany you to the nearest FedEx shoppe/store/offcie and do the shipment on July 1st.
It is my earnest advice and so is of many more here that filing on july 30th or earlier is risky and may end up with a rejection.

What does it take for lawmakers to turn their heads? People holding placcards and signs on streets protesting? Is that the only way to have something heard? Obviously, written articles such as these isn't helping!

Immigration Law from Houston Immigration Lawyer - Annie Banerjee Has Just Posted the Following:
There are only 65,000 visas given for regular H-1Bs and 20,000 for holders of US Master's Degree. As of July 09, only 24,800 regular petitions were filed and 10,600 US Master's petition were filed. The reason for this slow filing is two fold.
Heading into a deeper recession, the economy is definitely a factor. Unlike what most people think, Companies would rather hire US workers, and not pay the $2320/- filing fees plus attorney's fees.
However there are some professions which have a shortage in the US. That is true of computer professionals. But the computer professional market has been bruised by a poorly conceived and legally impermissible memo that CIS promulgated on January 08, 2010. The CIS is their infinite wisdom deemed that professionals need to be "controlled" directly by the petitioning company.
The IT business typically have contracts that go through tiers--- from the petitioning company to the end user. The CIS thinks that this creates "job shop" a four letter word to them.
The Jan 08 memo is startling in how unconstitutional it is---- how it totally disregards the rule of law. The class action lawsuit against it will hopefully see the end of the memo. Meanwhile software companies are outsourcing their business elsewhere.
However if there is a contract using an intermediary, control can be shown if another employee of the same H-1B employer works for the end user and actually supervises the H-1B beneficiary.
For instance if Company A, the H-1B employer has a contract with Company F and Company F has a contract with the end user, Company Bigshot. If Company A has employee X who works for Big Shot too, who supervises employee Y, who is the beneficiary, then control can be established under the January 08 memo. Of course all companies have to provide a ton of document to prove the case.

This is a big scam. I see there is a big political heads intervention in this for reversing july bulletin.
Since everything is coming out day by day, politicians also started escaping out.
Now USCIS should look for its own safety as the politicians who suported them earlier had given HAND to them now.
As part of safe game, they sent out that numbers to DOS, saying that we cant allocate numbers, and thrown ball into DOS court now.
Everyone is playing their own safe game.
What i feel at this moment, instead of digging the scam further, a big guy should negotitate with USCIS and ask them to revert back to initial bulletin giving an assurance that no digging will be done in the scam. I dont know how far this will happen, as already the matter is going to the court now.

What are all the documents needed for travel on AP? I am travelling JFK->Dubai->India. I am guessing there is no transit visa mess involved here since there is no Europe stop.

1) 3 sets of AP valid till october 2008
2) EVL
3) Current pay stubs
4)H1 approval (valid till 2010, no needed but still have it)
Do I need w2 and tax returns etc?

It took a little over 3 months for my H1 to get renewed but I wouldn't base anything on this. Its govt... if they feel like working they will approve yours in 3 weeks and if they don't you can read Bose's issue. I have lost all respect for functioning of govt.

My case is - PD Nov 2007 , I-140 approved June 2008. I -485 is not applied. Can I change Job on this basis and still maintain my Priority date ?
BTW : Current company lawyer does not give copy of receipt of I-140 ( says its company property) though I know the LIN #.

Is letter from employee needed for filing I-485 for my spouse. I filed I-485 under EB3 last August and it's still pending. She takes my PD and my PD will be current in May. I have an old letter from my employer when filing my I-485 last August but was wondering if a new letter from employer is needed or the old one would do.

Hi,
I filed my EAD and AP renewal on Sept 17 (20 days) ago but still I haven't heard received neither receipt notice nor my check being cashed. Is there anything we can do to find out about the receipt notice? Fedex tracking shows the mail being already delivered. I am currently working on EAD and recently used AC21 to switch the company so EAD is very important to me.
Please provide your feedback and if anyone is having same delays in getting receipt notice for EAD / AP.

Did you send your application by Fedex or some other courier that had tracking? Are you able to track when the package(s) reached the Service Center? Which Service Center did you filed your applications at?

Congrats! good to see an EB3 I from July 2003 getting his GC.
I got my GC but my wife's application (based on my 485) is still pending. I think at this point I can switch jobs/go to school full time and it won't affect my spouse's case. Just want to double check on this, any thoughts??

My friend got laid off on Dec 19th 2008. And he got another job, but the new employer is not providing him Group Health Insurance. They are asking to take him Individual Family plan and saying they will reimburse. But the problem is, he is in Albany, NY and he got to know that they are no individual plans in NY which is really odd.
He wants to use COBRA but it's really expensive 1200$ per month. But luckily we saw that there is a 65% discount for people who laid off between 1st Sept 2008 and Dec 31st 2008.
But want to know whether H1b employees are eligible for this discount or only American Citizens and Green Card holders?
