1. Why extension was denied, what was in RFE?

b. they needed company no.of employers update info which uscis did not have on there record.
c. client letter
d. clearly defined path between employer and client relationship( had 2 vendors between them) I had to show contracts and workorders between each of them.
2. Did you get the approval for Company X after your apeal
venu_mk: appeal on denial case is still in process. what i heard after talking to different lawyers is it will take atleast 6 to 9 months of time. im still waiting on that.
3. Why are you still working with Company X,and when do you plan to join Co. Y
venu_mk: because i cannot work with company Y unless i get visa stamped.i talked to owner of company Y he said he wont generate pay stubbs unless i get stamped. One thing is i have applied I-797 from Company Y through CONSULAR PROCESSING. my lawyer says the same thing u cannot work on Company Y unless u get stamping done.
4. Are you going to get visa stamped with Co. X or Co. Y

On I-797 from Y it doesn't have I-94 number on it anywhere. since its through consular processing.
In order to work with Y, i have to get stamped first then only pay stubbs are generated
The result of the appeal is still pending....
one thing for sure that i have decided is that , I will only go for stamping AFTER my PIMS Verification is done in TIjuana, Mexico.
I'm pretty confused...

and it's still valid for almost 2 years.
If, say, I find another employer in a few months, can I use the visa that I have now?
If so, can I start working for that employer once he files a new petition, or do I have to wait until the new approval notice?

I did same 4 years ago. You can travel while your H1B transfer is pending.

I got a new stamping before i came back to US. But while my application was pending, i called US Consulate in India they said you don't need one as long as current stamping on passport is valid. They said you just need to show new company's appointment/employment letter at immigration if questioned. But better to check with attorney, my attorney asked me to get stamped and come back

To the best of my knowledge and what I have heard from our international office and immigration lawyers: Once you are counted (Baptised!!!), you do not need to worry about cap-subject ceiling.
For making it doubly sure, always check with recruiting firm's lawyers and your non-profit company's lawyers. They will be doing the paper work. If confusions previal, you can give advise, counsel or consult attorney.
My guess is: this is well known fact and may not need attorney. See what others say.

I tried applying for License Renewal inn NC when my H1 was pending with USCIS, they strictly told me that they will not issue the license until we get the approval notice from USCIS. if you have any luck please let me know?

I don't know about legal risks but health-wise that sounds quite risky.

If every one thinks like you, how in the world would drugs be developed to cure the diseases? :D :) Note that before any drugs gets to the stage of human subjects research, it would have completed several trials to ensure that its safe. Adverse events may happen during the trial but in recent studies, not many.
Generally, there will be an orientation and screening before enrollments, you will get all the information at that stage and you may choose not to enroll or if you have any particular condition identified during screening, you will not even be enrolled.
Risks are very minimum. Good luck.

Send RFE reply with USCIS approved doctor's letter to explain the details. Only medical expert can comment about the vaccine. No one can impose vaccine if it is not appropriate with the age.
I am posting this on behalf of a friend. They (husband/wife) got their green card approval last week, however they got 2 RFEs for their 2 kids. The RFE is about a vaccine called PNEUMOCOCCAL (PCV/PPV) that's not been administered for the kids. The RFE mentions the requirement for this vaccine but the doctor deemed it as NOT-AGE-APPROPRIATE in their filed medical forms.
Our guess is that when they actually administered the vaccine about a year or so ago, it was deemed "Not age appropriate" but now upon approval, the USCIS deems it necessary. I'd appreciate it if anybody with similar experience can post as to how they handled the situation or any insights into who to talk to is also much appreciated. The family is currently not in the country and therefore their options are limited in terms of talking to or meeting someone face to face. Also they need to respond to the RFE by June 24.

Hi guys,
I have the following clarification:
Earlier, I was working with Employer A and came to US after getting H1-B stamped.
Subsequently, my spouse has got her H4 visa stamped.
So, both of our visas are valid till 30th Sept 2007. My wife joined me in December 2005.
Then I changed my employer in April 2006, where I got my I-129 approved from Employer B.
In the meantime, my wife/spouse went to India in April 2006 & came back to US using old visa on July 15th 2006.
At port of Entry she got I-94 valid till 30th Sept 2007 (validity date of the old visa A)
I never got her I-94/H4 using the new I-129 from Employer B (Current Employer).
On July 3rd, I submitted my I-485 AOS for both of us.
I have the following question:
1. Is her I-94 still valid based on the old visa ?
2. Will there be any issues for not filing for H4 visa till now, even though I am planning to
apply right away as her I-94 is getting expired on 30th Sept 2007.
3. Is she out of Status as I left the old employer more than 180 days ago.
4. Will she have any issues as far as AOS is concerned.

� New labor is not as fast to get approved as was earlier. It is taking from anywhere 12-14 months now a days to get it approved. It is only after labor approval that you can port.

I am on my 2nd phase of H1B visa which is valid until 2012.
I want to quit my job and go back to my home country.
How long after I quit my job do I get to stay here to wrap up and ship my stuff??
Does that jeopardize my status? I plan to be here for about 30 days after quitting my job. WOuld that be ok? or is it overstaying?
If I ever need to apply for a tourist visa in future will this jeopardize my chances of getting a visa then?

If you have been in the US for more than 1 year, you are a resident of the US and not any particular state in India. You are free to go to any Consulate in India. Even though I was previously a resident of AP, I have been able to get successful stamping in New Delhi.

I came back to US alone and changed to company B in July 06 and got my I-94 till 2009. Since my wife came to USA after that she didnt get her xtension.
i forgot to file for her xtension.
I had to agn change the company C in Dec 06. Thats whn i realised her I-94 expired in Nov. I applied for her I 539. But it wasnt approved by INS.
I have decided to send her back before 180 days, because if she crosses 180 days, it can be a 3 yr ban.
She will have to go back to consulate now now for visa stamping. Will she have a problem?

But at the worst case, the USCIS will just approve her I-539 as non extension of status (which means she doesn't get a new I-94 with the extension and rather just gets a H4 approval and would be asked to go to the home consulate for visa stamping and reentry.) . Hence my bet would be to wait for her I-539 approval and then make the decision. But most likely her I-539 extension of status would be just approved (ie she would get a new I-94 with new extension date ) and she doesn't have to travel back to the consulate.

My initial receipt date for I-485 from Vermont service center was July 7th 2007. But when I-485 was transferred to Texas service center, receipt date on I-485 is showing as September 11th 2007. Can we do anything to correct the wrong receipt dates as this might have significant impact on my processing times. Please advice
